San Antonio Patent Defects
Patent defects are faults which are difficult to find by normal scrutiny before the purchase. The law states that the buyer and seller should undergo inspection and they should arrive in a mutual understanding before the transaction. However it is found that the inspection under the law is not enough to prevent the defect. As in an case if the purchaser is buying a ready made house then he can not check the strength of the building or of any object present there.

The government expects the buyer to protect it against the defect. During the sale the clause may be stated such that the seller may have to pay for the damages or defects found over it after the purchase. If such damages were found then the seller would be asked to pay the money as compensation or else he would have to replace the damaged or defective part. The buyer can not claim the compensation when no such agreement was signed. If the defect was found and even if the agreement was signed then the buyer has to prove that the seller was aware of the defect even before the sale. If he fails to prove this then he can not successfully recover the compensation.
If the seller has actively hidden the defect then the buyer can not claim the compensation. In most of the cases of the defect the buyer succeeds unless the seller successfully proves that the buyer was aware of the defect even before the sale. In this case the buyer will fail to recover the compensation.
